END USER LICENSE AGREEMENT (EULA)

This User Agreement is a legally binding contract. Please read it carefully before using DoctorsAppointment.ai or subscribing to any services. By using our App, you agree to all terms in this document.

• This App does NOT provide medical advice or diagnoses
   
• You will always consult healthcare professionals for medical decisions
   
• Your chat messages are sent to OpenAI for AI processing
   
• Health profile data (Premium) may be shared with OpenAI for personalization
   
• The Provider Directory is a marketplace only — we do NOT verify credentials
   
• All provider information is self-attested by providers
   
• Contact unlocks expire after 24 hours and are non-refundable
   
• Subscriptions auto-renew and are non-refundable
   
• You release us from liability for health-related outcomes
   
• Disputes will be resolved through binding arbitration
   

This User Agreement (“Agreement”) is a legally binding contract between you (“User,” “you,” or “your”) and DoctorsAppointment.ai (“Company,” “we,” “us,” or “our”).

BY CREATING AN ACCOUNT, SUBSCRIBING TO OUR SERVICES, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT.

IF YOU DO NOT AGREE TO ALL TERMS OF THIS AGREEMENT, YOU MUST NOT USE THE APP OR SUBSCRIBE TO ANY SERVICES.

This Agreement incorporates by reference:

• Our Terms of Service
   
• Our Privacy Policy
   
• Any additional terms presented at subscription
   

You represent and warrant that:

• You are at least 18 years of age
   
• You have the legal capacity to enter into binding contracts
   
• You are not prohibited from using the App under applicable laws
   
• All information you provide is accurate and complete
   

PLEASE READ THIS SECTION CAREFULLY. THIS IS A CRITICAL PART OF THIS AGREEMENT.

DoctorsAppointment.ai provides AI-generated health information for educational and informational purposes only. The App does NOT provide:

• Medical diagnoses
   
• Treatment recommendations
   
• Professional medical advice
   
• Emergency medical services
   

By using this App, you expressly acknowledge and agree that:

a) You understand AI-generated health information may be incomplete, inaccurate, or not applicable to your specific situation.

b) You will always consult a qualified healthcare professional before making health-related decisions.

c) You will never delay seeking medical attention, disregard medical advice, or discontinue treatment based on information from this App.

d) You assume full responsibility for decisions made using information from the App.

e) In case of medical emergency, you will call emergency services (911) immediately and not rely on this App.

You hereby release, waive, and forever discharge DoctorsAppointment.ai from any and all liability, claims, demands, or causes of action arising from:

• Your use of health information from the App
   
• Medical decisions influenced by the App
   
• Delays in seeking professional medical care
   
• Any adverse health outcomes
   

The AI Health Assistant is powered by OpenAI’s GPT-4o API. By using the AI Health Assistant, you expressly consent to:

• Transmission of your chat messages to OpenAI for processing
   
• Transmission of images you share for visual analysis to OpenAI
   
• Processing of your data by OpenAI to generate responses
   

If you are a Premium subscriber and enable “Personalize AI Responses,” you additionally consent to sharing:

• Current medications
   
• Allergies
   
• Chronic conditions
   
• Age range (not exact date of birth)
   
• Gender (if provided)
   
• Smoking status (if provided)
   

This data is shared to provide safer, more relevant educational health information.

The following is never sent to OpenAI:

• Full name, email, phone number, or address
   
• Exact date of birth
   
• Medical record images stored in your profile
   
• Chat history from previous sessions
   
• Payment information
   

• OpenAI does not use API data to train AI models
   
• Data is retained for up to 30 days for abuse monitoring
   
• After 30 days, data is deleted

Premium users can withdraw consent for health profile sharing at any time via:

Profile > Preferences > Personalize AI Responses (toggle OFF)

You may stop using the AI Health Assistant at any time to withdraw consent for chat message processing.

The following data is stored locally on your device only and is not transmitted to DoctorsAppointment.ai servers:

• Complete health profile (personal info, medical history, lifestyle)
   
• Medical record images (MRI, X-rays, lab reports)
   
• Chat conversation history
   
• App preferences and settings
   

You have complete control over your data. You can:

• View all data stored in the App
   
• Edit your health profile at any time
   
• Delete individual medical records
   
• Clear your chat history
   
• Delete all data via Profile > Clear All Data
   
• Delete your account entirely
   

Your health profile data is stored locally and is accessible only through the App on your device.

We implement industry-standard security measures including encrypted local storage and TLS/HTTPS encryption for all data transmissions.

By using the App, you consent to collection, storage, and processing of your health-related information, including:

• Medical history
   
• Current symptoms
   
• Allergies and medications
   
• Chronic conditions
   
• Health queries and responses
   

You authorize us to:

• Use your health data to provide personalized educational information
   
• Store your health profile locally on your device
   
• Process queries through the AI service (OpenAI)
   
• Maintain records as required by law
   

You agree to:

• Provide accurate health information
   
• Update your profile when your health status changes
   
• Not provide false or misleading information
   
• Understand inaccurate data may result in inappropriate information
   

You acknowledge that no doctor-patient, therapist-client, or other healthcare provider relationship is created by using this App.

PLEASE READ THIS SECTION CAREFULLY. THE PROVIDER DIRECTORY IS A TECHNOLOGY MARKETPLACE ONLY.

DoctorsAppointment.ai operates a technology marketplace that allows patients to browse provider profiles and obtain contact information. By using the Provider Directory, you expressly acknowledge and agree that:

a) DoctorsAppointment.ai is a technology platform only and is not a healthcare provider, medical practice, referral service, or staffing agency.

b) We do not provide, arrange, or facilitate medical care, appointments, consultations, or healthcare services.

c) We do not participate in or mediate communications or relationships between patients and providers.

d) All contact between patients and providers occurs off-platform and is outside our services.

All provider information displayed in the App is self-reported and self-attested. You acknowledge that:

a) DoctorsAppointment.ai does not verify, validate, confirm, or authenticate any provider information including credentials, education, locations, availability, specialties, or standing.

b) Providers are solely responsible for accuracy and completeness of their profile information.

c) Directory presence is not an endorsement, recommendation, or verification.

d) You are solely responsible for independently verifying credentials, licensure, and qualifications.

No healthcare relationship is created through browsing profiles, unlocking contact info, or viewing provider information. Any relationship occurs outside DoctorsAppointment.ai and solely between you and the provider you choose.

You release DoctorsAppointment.ai from liability arising from:

• Provider conduct or services
   
• Any medical care or advice by providers
   
• Provider credentials, licensure, qualifications
   
• Accuracy of provider self-attested info
   
• Communications or interactions
   
• Fees paid to providers
   
• Disputes with providers
   
• Any harm resulting from provider services
   
• Provider failure to respond
   

You assume all risks associated with contacting providers, relying on self-attested information, and engaging provider services.

You agree to independently verify provider credentials, licensure, and disciplinary history and make your own informed decisions.

Providers may pay subscription fees for enhanced visibility or “Elite” status. Such payments:

• Do not constitute credential verification
   
• Do not imply endorsement
   
• Are solely for marketing visibility
   
• Create no obligation regarding provider services
   

The Provider Directory allows you to unlock provider contact information for a fee. By purchasing unlocks, you agree to the terms below.

• Unlock access lasts 24 hours from purchase
   
• Access expires automatically after 24 hours
   
• No extensions, pauses, or refunds for unused time
   

Unlocking contact information provides provider self-reported contact details only. We do not guarantee response, availability, or service acceptance.

All contact unlock purchases are final and non-refundable, including due to non-response, outdated info, dissatisfaction, display issues, accidental purchases, or unused time.

You agree not to:

• Share unlocked contact info
   
• Use it for spam/marketing
   
• Harass providers
   
• Use it unlawfully
   
• Resell or redistribute it
   

Violations may result in immediate termination without refund.

By subscribing to Premium, you agree to:

• Pay applicable fees
   
• Automatic renewal
   
• App store billing terms (Apple/Google)
   

You authorize charges for:

• Initial subscription fee
   
• Recurring fees
   
• Applicable taxes
   

• Cancel anytime in device settings
   
• Cancellation takes effect at end of billing period
   
• No refunds for unused time or partial periods
   

By subscribing, you acknowledge:

• No-refund policy
   
• Automatic renewal terms
   
• Responsibility for managing subscription
   
• Prices may change with notice
   

You agree not to engage in prohibited activities including:

• Using the App for emergency situations
   
• Relying solely on the App for medical decisions
   
• Sharing AI responses as professional medical advice
   
• Using the App for minors without proper authority
   

• Attempting to manipulate AI responses
   
• Inputting false or harmful health information
   
• Using the App to harm yourself or others
   
• Sharing graphic or disturbing content
   

• Reverse engineering
   
• Circumventing security measures
   
• Using bots or automated systems
   
• Interfering with app functionality
   

• Violating laws/regulations
   
• Infringing intellectual property
   
• Fraud
   
• Impersonation
   

• Creating fake provider profiles
   
• Misrepresenting credentials
   
• Solicitation/spam
   
• Harassment through contact channels
   

Violation may result in immediate termination without refund.

To the fullest extent permitted by law, DoctorsAppointment.ai is not liable for:

• Indirect, incidental, special, consequential, or punitive damages
   
• Loss of profits, data, use, goodwill
   
• Personal injury, illness, or death
   
• Medical expenses or healthcare costs
   
• Damages exceeding total fees paid by you in the prior 12 months
   

We are not liable for:

• Health outcomes or medical decisions
   
• Accuracy of AI-generated info
   
• Service interruptions
   
• Third-party actions/content (including OpenAI)
   
• Force majeure events
   

We are not liable for:

• Provider conduct, credentials, qualifications
   
• Patient-provider communications
   
• Medical care by providers
   
• Provider non-response
   
• Accuracy of self-attested info
   
• Disputes arising from relationships
   
• Fees paid to providers
   

AI may produce incorrect or inappropriate information. We do not guarantee accuracy, completeness, or reliability.

Limitations apply even if a remedy fails of essential purpose.

Some jurisdictions do not allow certain limitations. In such cases, liability is limited to the maximum extent permitted.

You agree to indemnify, defend, and hold harmless DoctorsAppointment.ai and affiliates from claims arising from:

• Your App use
   
• Agreement violations
   
• Third-party rights violations
   
• Health decisions/actions
   
• Submitted content
   
• Legal violations
   
• Provider interactions and related claims
   

We may assume exclusive defense of indemnified claims. You agree to cooperate.

You must notify us promptly of indemnifiable claims.

Any dispute arising from this Agreement or App use will be resolved by binding arbitration, not court.

Arbitration will be conducted:

• Under AAA rules
   
• In Delaware, United States
   
• By a single arbitrator
   
• In English
   

You waive the right to participate in:

• Class actions
   
• Class-wide arbitration
   
• Representative actions
   
• Private attorney general actions
   

Either party may bring qualifying claims in small claims court.

Claims must be filed within one (1) year.

This Agreement is governed by Delaware law.

Disputes between you and providers are solely between you and the provider. DoctorsAppointment.ai is not a party.

You may terminate at any time by:

• Deleting your account
   
• Cancelling your subscription
   
• Discontinuing use of the App
   

We may suspend/terminate without notice for:

• Agreement violations
   
• Fraud or suspicious activity
   
• Non-payment
   
• Provider misrepresentation
   
• Any reason at our discretion
   

Upon termination:

• Your right to use the App ceases immediately
   
• No refunds will be provided
   
• Provider profiles may be unpublished
   
• Data may be deleted after retention periods
   
• Certain provisions survive termination
   

This Agreement, Terms of Service, and Privacy Policy form the entire agreement between you and DoctorsAppointment.ai.

If a provision is unenforceable, the remainder stays in effect.

Failure to enforce a right is not a waiver.

We may assign rights. You may not assign rights without consent.

We may modify this Agreement. Material changes will be communicated. Continued use constitutes acceptance.
